Terms of Service

Terms of Service

Premier Mowing LLC
Effective Date: August 18, 2026

These Terms of Service (“Terms”) govern services provided by Premier Mowing LLC (“Premier Mowing,” “we,” “us,” or “our”) and the use of our website, estimates, quotes, scheduling systems, customer portal, payment systems, and related services.

By accepting an estimate or quote, scheduling or authorizing services, making payment, creating a customer account, or otherwise engaging Premier Mowing to perform services, the customer (“Customer,” “you,” or “your”) agrees to these Terms.

1. Services

Premier Mowing LLC provides property-maintenance and related services, which may include:

  • Lawn mowing and routine lawn maintenance
  • Landscaping
  • Mulch installation
  • Rock installation
  • Sod installation
  • Spring and fall cleanups
  • Leaf and debris removal
  • Skid-steer services
  • Topsoil and material delivery
  • Debris haul-off
  • Snow and ice management
  • Other property-maintenance services specifically identified in an accepted estimate, quote, proposal, or service agreement

The specific services provided to a Customer will be determined by the estimate, quote, proposal, recurring service agreement, work order, or other communication accepted by the Customer.

2. Estimates and Quotes

Unless otherwise stated, estimates and quotes are based on the property conditions, scope of work, materials, labor requirements, accessibility, and information reasonably available to Premier Mowing at the time the estimate is prepared.

Additional charges may apply when actual conditions differ materially from those represented or reasonably observable when the estimate was prepared.

Examples may include:

  • Excessive or unusually tall grass
  • Excessive debris
  • Hidden obstacles
  • Difficult or restricted access
  • Unexpected site conditions
  • Additional labor requested by the Customer
  • Additional materials
  • Changes in the requested scope of work
  • Conditions that prevent normal use of equipment
  • Additional disposal or haul-off requirements

Premier Mowing will make reasonable efforts to communicate material changes in price before performing substantial work outside the originally agreed scope.

Quotes and estimates are valid for the period stated on the quote. If no expiration date is stated, Premier Mowing reserves the right to revise pricing before work is scheduled or performed due to changes in material costs, labor costs, fuel costs, site conditions, or the scope of work.

3. Acceptance of Services

A Customer may authorize work through electronic acceptance of an estimate, written approval, electronic communication, scheduling authorization, payment of a deposit, or another method reasonably indicating approval of the proposed work.

Acceptance constitutes authorization for Premier Mowing to perform the services described in the applicable estimate, quote, proposal, or service agreement.

4. Recurring Lawn Maintenance

Customers enrolled in recurring lawn maintenance authorize Premier Mowing to provide service according to the agreed service frequency.

Recurring service may be weekly, bi-weekly, or another schedule agreed upon by Premier Mowing and the Customer.

Service dates are approximate and may change due to weather, holidays, equipment issues, staffing, route optimization, property conditions, or other circumstances.

Premier Mowing does not guarantee service on a specific day of the week unless specifically agreed to in writing.

5. Weekly and Bi-Weekly Service

Weekly and bi-weekly pricing assumes the property is maintained at the agreed frequency.

Bi-weekly properties may experience greater grass growth between services and therefore may require additional labor and equipment time.

Premier Mowing may establish different minimum pricing for weekly and bi-weekly properties and may adjust service pricing when the condition of a property requires substantially more work than contemplated by the recurring service agreement.

Skipping scheduled services may result in additional charges if the property requires additional labor during the next service.

6. Weather and Service Delays

Outdoor property-maintenance services are inherently dependent upon weather and ground conditions.

Rain, storms, excessive heat, snow, saturated ground, drought conditions, equipment limitations, or other circumstances may delay or modify the service schedule.

Premier Mowing reserves the right to delay service when performing the work could:

  • Damage the Customer’s property
  • Create unsafe working conditions
  • Damage Premier Mowing’s equipment
  • Produce an unacceptable quality of work

Weather-related delays do not constitute a breach of these Terms.

When practical, Premier Mowing will resume service as soon as conditions reasonably permit.

7. Customer Responsibilities

Customers are responsible for providing Premier Mowing with reasonable and safe access to the property.

Before scheduled service, Customers should:

  • Remove toys, hoses, pet waste, lawn furniture, and other movable objects from service areas.
  • Ensure gates are unlocked or provide necessary access information.
  • Secure pets and animals.
  • Identify underground or concealed hazards known to the Customer.
  • Identify irrigation components, invisible fencing, drainage systems, cables, wires, landscape lighting, or other items that may not be readily visible.
  • Inform Premier Mowing of known hazardous conditions.

Premier Mowing is not responsible for damage to objects that are concealed, improperly installed, left within service areas, or not reasonably visible to our crews.

8. Underground Utilities and Irrigation

Customers are responsible for informing Premier Mowing of privately installed underground systems that may not be identified through standard utility-location services.

These may include:

  • Irrigation systems
  • Invisible pet fencing
  • Private electrical wiring
  • Landscape lighting
  • Drainage systems
  • Private water lines
  • Septic components
  • Other privately installed underground systems

For projects involving excavation or ground disturbance, Premier Mowing may require utility locating before work begins.

Premier Mowing is not responsible for damage to improperly marked, unmarked, concealed, or inaccurately identified private utilities or systems except to the extent responsibility cannot legally be excluded.

9. Property Damage

Premier Mowing will exercise reasonable care while performing services.

If a Customer believes Premier Mowing caused property damage, the Customer should notify us promptly and provide reasonable documentation of the alleged damage.

Premier Mowing must be given a reasonable opportunity to inspect the alleged damage and, when appropriate, repair the damage or otherwise resolve the matter before the Customer independently arranges repairs for which reimbursement is sought.

Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

10. Landscaping and Installation Services

Landscaping, mulch, rock, sod, planting, and similar projects may be affected by natural conditions outside Premier Mowing’s control.

Unless expressly provided through a written warranty, Premier Mowing cannot guarantee the long-term survival or performance of:

  • Sod
  • Grass
  • Trees
  • Shrubs
  • Plants
  • Seed
  • Other living landscape materials

After installation, proper watering, maintenance, and care become the Customer’s responsibility unless ongoing maintenance is specifically included in the agreement.

Premier Mowing is not responsible for loss caused by drought, excessive rain, freezing temperatures, extreme heat, disease, pests, animals, improper watering, Customer neglect, or other conditions outside our reasonable control.

11. Materials

Natural materials such as mulch, stone, topsoil, sod, and plants may vary in appearance, texture, shade, size, or composition.

Samples and photographs are representative only and do not guarantee an exact appearance.

Material quantities are estimates based on measurements and expected coverage. Additional material may be necessary based on actual site conditions.

12. Snow and Ice Services

Snow and ice management services are performed according to the applicable agreement, service trigger, weather conditions, and accessibility of the property.

Snow and ice conditions are inherently hazardous.

Premier Mowing does not guarantee that a property will remain completely free of snow or ice following service. Refreezing, additional precipitation, drifting, traffic, temperature changes, and other environmental conditions can create hazardous conditions after service has been completed.

Customers remain responsible for exercising reasonable caution and monitoring their property for changing conditions.

13. Skid-Steer and Equipment Services

Skid-steer, grading, material-moving, and related equipment services may be billed by the hour, by the project, or according to an accepted estimate.

When services are billed hourly, billable time and any applicable minimum charge will be disclosed in the applicable estimate or agreement.

Unexpected subsurface or property conditions may require additional work and may result in additional charges.

14. Pricing

Prices are based on the service scope and conditions existing at the time pricing is established.

Premier Mowing reserves the right to periodically adjust recurring service pricing due to factors such as:

  • Increased labor costs
  • Fuel costs
  • Insurance costs
  • Equipment costs
  • Material costs
  • Changes in property conditions
  • Changes in service frequency
  • Changes in the scope of work
  • Increased time required to service the property

Customers will receive reasonable notice of material recurring price changes before the new price takes effect.

15. Taxes

Applicable sales, use, or other taxes required by Kentucky or other governmental authorities will be added to invoices when required by law.

The Customer is responsible for all legally applicable taxes associated with the purchased services or materials.

16. Invoicing and Payment

Customers agree to pay invoices according to the payment terms stated on the applicable estimate, invoice, service agreement, or customer account.

Premier Mowing may accept payment through credit card, debit card, ACH/bank transfer, check, cash, or other approved payment methods.

Payments processed electronically may be handled by third-party payment processors.

Customers are responsible for maintaining accurate billing and payment information.

17. Payment Methods on File and Automatic Payments

When a Customer voluntarily provides and authorizes a payment method to be stored through our payment-processing or customer-management system, the Customer authorizes the applicable payment provider to securely maintain that payment method.

Premier Mowing will only charge a stored payment method when authorized by the Customer, including through an applicable recurring payment, autopay, service agreement, invoice authorization, or other valid payment authorization.

Customers are responsible for keeping stored payment information current.

18. Deposits

Premier Mowing may require a deposit before scheduling or beginning certain projects.

Deposit requirements will be disclosed before payment.

Unless otherwise agreed in writing, deposits may be applied toward materials, scheduling commitments, equipment reservations, labor preparation, or other project costs.

Refundability of a deposit may depend upon whether Premier Mowing has already incurred expenses, ordered materials, reserved equipment, or allocated labor for the project.

Any non-refundable deposit requirement will be disclosed when required by applicable law.

19. Late and Unpaid Accounts

Invoices are due according to the payment terms provided to the Customer.

If an account becomes past due, Premier Mowing may:

  • Suspend future services
  • Cancel recurring service
  • Decline additional work
  • Require payment before future services
  • Require a payment method on file
  • Pursue lawful collection remedies

Any late fee, collection fee, interest, or other charge will only be imposed when disclosed and permitted by applicable law or agreement.

Customers remain responsible for amounts properly owed for services already performed.

20. Cancellations and Service Changes

Customers should provide reasonable notice when canceling or rescheduling one-time projects or services.

Premier Mowing reserves the right to charge reasonable costs associated with a cancellation when materials have already been purchased, equipment has been rented or reserved, subcontractors have been committed, or other nonrecoverable project expenses have been incurred.

Recurring mowing Customers may request cancellation of future service by contacting Premier Mowing.

Cancellation does not eliminate amounts already owed for completed services.

21. Right to Refuse or Terminate Service

Premier Mowing reserves the right to refuse, suspend, or terminate service when reasonably necessary, including for:

  • Nonpayment
  • Unsafe property conditions
  • Threatening, abusive, or inappropriate behavior
  • Repeated access problems
  • Unsecured aggressive animals
  • Misrepresentation of property conditions
  • Requests to perform unlawful or unsafe work
  • Circumstances that make continued service commercially unreasonable

Customers remain responsible for authorized services performed before termination.

22. Communications

By providing a telephone number or email address, Customers authorize Premier Mowing to send communications reasonably related to their inquiry, estimate, scheduled services, account, invoices, payments, weather delays, and other customer-service matters.

Where permitted and appropriately authorized, Premier Mowing may also send promotional communications.

Customers may opt out of promotional text messages by replying STOP and may unsubscribe from promotional emails using an available unsubscribe method.

Opting out of promotional communications does not necessarily prevent Premier Mowing from sending non-marketing communications reasonably necessary to administer an active customer relationship or provide requested services.

Message and data rates may apply.

23. Privacy and Personal Information

Premier Mowing collects and processes personal information in accordance with our Privacy Policy and applicable law.

Information may include contact information, service addresses, property information, billing information, service history, communications, website information, and other information reasonably necessary to provide and administer our services.

Payment information may be processed and securely stored by third-party payment processors rather than directly by Premier Mowing.

Premier Mowing does not sell customer personal information for monetary consideration.

Customers may review our separate Privacy Policy for additional information regarding our privacy practices, data retention, security, third-party service providers, and applicable consumer privacy rights.

24. Photographs and Service Documentation

Premier Mowing may photograph a property before, during, or after services for legitimate business purposes including estimating, documenting property conditions, documenting completed work, quality control, training, and resolving customer questions.

Premier Mowing may also use photographs of completed work for marketing purposes.

We will make reasonable efforts to avoid unnecessarily displaying identifying information such as house numbers, vehicle license plates, or personal information in publicly used marketing photographs.

Customers who do not want photographs of their property used for marketing purposes may notify Premier Mowing.

25. Website Use

Customers and website visitors agree not to misuse Premier Mowing’s website or electronic systems.

Prohibited activity includes attempting to gain unauthorized access to systems or customer accounts, introducing malicious software, interfering with website operation, submitting fraudulent information, or using our website for unlawful purposes.

26. Intellectual Property

Premier Mowing’s business name, logos, graphics, photographs, website content, advertising materials, written materials, and other original content may be protected by trademark, copyright, or other intellectual-property laws.

No rights to such materials are granted except for ordinary personal use of our website and services.

  • Electronic estimates
  • Invoicing
  • Payment processing
  • Website hosting
  • Email and text communications
  • Accounting

Use of certain third-party services may also be subject to the terms and privacy policies of those providers.

Premier Mowing is not responsible for outages, failures, security incidents, or other circumstances caused solely by independent third-party systems outside our reasonable control.

28. Limitation of Liability

To the maximum extent permitted by applicable law, Premier Mowing will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from services or use of our website.

This limitation does not apply to liability that cannot legally be waived or limited.

Nothing in these Terms is intended to eliminate any rights or remedies that a Customer is entitled to under applicable law.

29. Force Majeure

Premier Mowing will not be responsible for delays or inability to perform services caused by circumstances reasonably outside our control, including severe weather, natural disasters, government actions, labor shortages, supply-chain disruptions, equipment failures despite reasonable maintenance, utility interruptions, emergencies, or other extraordinary circumstances.

We will make reasonable efforts to resume affected services when conditions permit.

30. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

Any dispute relating to services provided by Premier Mowing will be subject to applicable Kentucky and federal law.

31. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

32. Entire Agreement

These Terms, together with the applicable estimate, quote, proposal, service agreement, invoice terms, payment authorization, and Privacy Policy, constitute the agreement between Premier Mowing and the Customer regarding the applicable services.

If a specific written estimate, contract, or service agreement contains terms that conflict with these general Terms, the terms of the specific agreement will control with respect to that service.

33. Changes to These Terms

Premier Mowing may periodically update these Terms to reflect changes in our services, business practices, or applicable law.

The “Last Updated” date will identify the most recent version.
